General terms and conditions of sale

The general terms and conditions of sale, hereinafter referred to as "the Terms and Conditions", define the rights and obligations of the parties in connection with sales made on the website hereinafter referred to as "the site". These terms and conditions are concluded between, on the one hand, CAPSAE , and on the other hand, the persons wishing to place an order for product(s) via the site, hereinafter referred to as "the customer".
Ordering products presented on the website is subject to the customer's acceptance of all the General Terms and Conditions of Sale as set out below. These General Terms and Conditions of Sale prevail over all other conditions, including those in force for in-store sales, and are binding on the customer regardless of any advertising or promotional materials that may be issued by CAPSAE .
CAPSAE reserves the right to adapt or modify its Terms and Conditions at any time. In the event of modification, the Terms and Conditions applicable to the order will be those in effect on the date of final payment for the order.

Price

Prices are shown in € euros and include any applicable discounts.

Any order placed on the site and delivered outside of France may be subject to potential taxes and customs duties which are imposed when the package arrives at its destination.
Any customs duties and taxes related to the delivery of an item are the responsibility of the customer. CAPSAE is not obligated to verify or inform the customer of applicable customs duties and taxes.

The prices shown are guaranteed while stocks last, except for significant changes in costs and except for typographical errors or omissions.

The prices shown do not include shipping costs, which will be charged separately and specified to the customer upon final confirmation of their order.

CAPSAE reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time the order is validated, subject to product availability. If a validated order contains one or more errors (price, description, photo, etc.), CAPSAE reserves the right to cancel it and issue a refund.

Payment terms.

Payment for your purchases on the Site is exclusively in Euros and can be made either by credit card or PayPal. PayPal allows you to pay directly without sharing your financial information online. You do not need a PayPal account to purchase from the store using PayPal.

Payments by postal check, bank check, transfer or administrative order are not accepted.

Shipping and deliveries.

Any order placed on the CAPSAE website will be prepared and shipped within 2 to 5 working days, subject to payment validation.

To ensure these delivery times are met, the Customer must provide accurate and complete delivery address information. The ordered product is delivered by tracked mail (La Poste) to the address indicated on the buyer's order form.

The delivery times indicated are after order processing and are expressed in business days. These times are those displayed by the carrier (La Poste). These times may be affected by strikes, export issues, customs changes, and other external problems for which we cannot be held responsible, or by any other technical problems beyond our control. In such cases, the customer will be informed by email or telephone.

If the customer has not received their order but it is deemed "Delivered" via the La Poste tracking tool, CAPSAE will not be held responsible and the customer will have to make a claim with the carrier themselves.

Product returns - Refund policy

In accordance with Article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days to exercise their right of withdrawal without having to give reasons or pay penalties, with the exception, where applicable, of return shipping costs." This period begins from the date of receipt of the products.

To exercise their right of return, the Customer must submit a return request to capsae.bijoux@gmail.com with all relevant product and order information. Items must be returned in their original packaging, in perfect condition for resale, and accompanied by their order number. Otherwise, the products will not be refunded, returned, or exchanged. Please note that return shipping costs are the responsibility of the Customer, and it is strongly recommended to use a tracked letter or parcel service. These conditions do not apply to personalized items, orders for sale or promotional items, or orders using a promotional coupon code.

When the right of withdrawal is exercised, the Seller undertakes to reimburse the Customer for all sums paid, without undue delay and at the latest within 14 days from the date of receipt of the product(s). The refund will only be issued if all these conditions are met.

Management of personal data.

Providing the personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and shipping orders, issuing invoices, and establishing warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (law no. 78-17 of 6 January 1978), the Customer has the right to access, view, modify, correct, and delete the data they have provided. Furthermore, CAPSAE undertakes never to disclose its customers' contact information to any third party, whether free of charge or for consideration.

Intellectual property.

All elements appearing on the Site: creations, models and photos are the exclusive property of CAPSAE , a trademark registered with the INPI (French National Institute of Industrial Property). Any reproduction or use without the prior consent of the Seller is strictly prohibited and may be subject to penalties under Intellectual Property law.
